TERMS AND CONDITIONS

The terms and conditions contained and described here on the Company's website (to be referred to in its entirety as "The Agreement") shall be binding and enforced on all customers of USGOLDREFINING and shall insure the benefit of USGOLDREFINING and their successors and assigns. If you would like a written copy of this agreement please contact us. USGOLDREFINING purchases second hand jewelry, coins, watches, and other valuables for the purpose of refining and resale. Prices are determined on weight, karat grade, and quality and are determined by USGOLDREFINING and its affiliates. If you would like a quote on your item(s) for sale, before shipping to us, please contact us.

REQUIREMENTS FOR USE

All customers are required to be over twenty-one years of age in order to sell precious metals or jewelry to USGOLDREFINING. All customers must be legal owners of said property that is sold to us or attempted to be sold to us. Every customer must be acting on their own behalf not as an agent or representative of another party. USGOLDREFINING may, but shall not be obligated or required to, request documentation or other proof of compliance with the requirements contained in this paragraph. By shipping your items to USGOLDREFINING, you are agreeing to all of our terms and conditions set forth and herein and those described on our website, USGOLDREFINING.COM.

GUARANTY AGAINST LOSS

USGOLDREFINING will guaranty against loss of the total contents properly and legally shipped to USGOLDREFINING in accordance with the instructions and procedures established by USGOLDREFINING and subject to the terms and conditions as described by USGOLDREFINING.COM. USGOLDREFINING reserves the right, in its discretion to reject delivery of any mail, envelope or package which appears to have been opened, damaged, or tampered with. Any such mail item will be returned by the post office to the customer. USGOLDREFINING shall have no liability to any customer or client for any attempted delivery or return of such items.

LIMITATION OF LIABILITY

This limitation of liability shall be binding on all customers, any third party, including but not limited to, the customer and the customer's successors, assigns, insurance carriers and any individual or entity asserting any right or claim relating to the customer's transaction with USGOLDREFINING. In no event shall USGOLDREFINING be liable for any damages from the loss or destruction of property in its possession for any reason, including negligence. In no event shall USGOLDREFINING be liable to any third party, including any insurance carrier. USGOLDREFINING shall not be liable for any subrogation claim brought by the customer's insurance carrier, and by submitting items to USGOLDREFINING, a customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier. USGOLDREFINING's liability is and shall be expressly and specifically limited to the least of the following sums:

  1. The liquidation value placed on the contents by USGOLDREFINING's sole discretion.

  2. One third of the appraised value of the contents according to an appraisal submitted by a customer/seller to USGOLDREFINING, which appraisal was issued prior to the shipment of the item to USGOLDREFINING.

  3. The sum of one hundred dollars.

The customer/seller expressly acknowledges and agrees that if there is no appraisal which was issued prior to the contents being submitted to USGOLDREFINING, the liquidated value shall be conclusive and binding and in no event shall USGOLDREFINING's liability exceed one hundred dollars.

USGOLDREFINING shall not be liable to anyone for any damages, included but not limited to, consequential, punitive, incidental, loss of profit or opportunity, other than set for herein above. By submitting items, customer explicitly and expressly accepts the limitation of liability. If you believe your items submitted to us for sale exceed the amount of one hundred dollars we recommend that you insure your package separately. We also would advise you to list your items on the brochure that was mailed to you.

VERBAL OFFERS

Any customer or seller may request USGOLDREFINING to provide a telephone or email quote for his or her items after they have arrived at USGOLDREFINING's facility. Verbal offers may, at USGOLDREFINING's discretion be recorded. Upon verbal acceptance by the customer of the telephone or email quote, payment will be issued by USGOLDREFINING within twenty four (24) hours, and the ten day customer satisfaction holding period guaranty will no longer be applicable to such transaction.

GOLD CHART DISCLAIMER OF LIABILITY

USGOLDREFINING is not responsible nor shall it be held liable for the contents of the gold charts found on its website. These charts are prepared and distributed by third parties other than USGOLDREFINING, and such be considered general information for its customers. USGOLDREFINING is not liable to anyone who relies on the information contained in said charts.

RETURN INSURANCE LIABILITIES

If an item is returned to a customer, USGOLDREFINING will insure the item for no more than the amount offered by USGOLDREFINING regardless of what it was insured for when mailed by the customer to USGOLDREFINING's facilities, unless USGOLDREFINING is otherwise notified by email or fax by the customer prior to the return shipment and the customer agrees to pay for any extra insurance requested. USGOLDREFINING shall in its sole discretion, choose the return carrier, insurance, and receipt verification method for each transaction.

CHOICE OF LAW, WAIVER, AND CLAIMS

This agreement shall be governed by the laws of the State of California without regard to its conflict of law provisions. USGOLDREFINING's failure to exercise or enforce any right or provision of the agreement will not be deemed to be a waiver of such rights or provisions. If any provision of the agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the agreement remain in full force and effect. You agree that regardless of any statue or law to the contrary, any claim or cause of action arising out of or related to the use of services offered by USGOLDREFINING must be filed within one year after such claim or cause of action arose or forever barred. Any such claim or cause of action must be filed in the State of California. USGOLDREFINING shall be entitled to reimbursement for any and all costs incurred by it in defending and civil action filed or attempted to be filed in any jurisdiction outside the State of California, including but not limited to, attorney's fees incurred by USGOLDREFINING.

If you change your mind about selling your items or are unsatisfied with the amount of the payment you received, you must notify us immediately. If we do not hear from you by telephone or fax within ten (10) days of the date on the check we mailed to you, your items will be processed by us and either melted or resold. You must return the check before we will return your items. The time limitation cannot be waived for any reason. USGOLDREFINING will not be responsible for any loss or damage of any kind if the time limitation is not followed. USGOLDREFINING will charge a return shipping and handling fee to return the item(s). Any items returned to the customer from USGOLDREFINING will be shipped within 14 days from receipt of the returned check.
